Terms and conditions

These Terms and Conditions (the “Terms”) govern the provision of electric vehicle(EV) charging services to individuals through the FOREVO Charging Stations network(the “Services”).

FOREVO CHARGING STATIONS L.L.C., a company registered in Dubai, United ArabEmirates (hereinafter “FOREVO,” “we,” “us,” or “Operator”), hereby makes this publicoffer to any individual wishing to use the Services.

By installing the Mobile Application, creating a User Account, or using any FOREVO charging station, you (“User” or “you”) acknowledge that you have read, understood, and fully accept these Terms, thereby entering into a legally binding contract with FOREVO.

1. TERMS, DEFINITIONS, AND ABBREVIATIONS

1.1. Bank Payment Card (BPC) – a personalized card issued by a bank enabling
non-cash payments for goods and services.

1.2. Internal Balance – funds available in the User’s account in the Application to pay for the Services.

1.3. Charging Session – the process of charging the User’s electric vehicle battery, from the start to the end of charging.

1.4. Mobile Application (Application) – software for smartphones, tablets, or other mobile devices that allows access to EV charging services, payments, and serviceinformation.

1.5. Partner – a legal entity that owns or operates the Application.

1.6. Payment – crediting or debiting funds to/from the Internal Balance or BPC.

1.7. User – an individual using the Application to receive the Service and who hasaccepted this Agreement.

1.8. Electricity Meter – a device measuring electricity delivered during a Charging Session to determine the Service volume.

1.9. Website (forevo.ae) – the Operator’s website providing information on the EVCS Network and services.

1.10. FOREVO Charging Station Network (EVCS Network) – a network of electric vehicle charging stations listed on the Website.

1.11. Technical Support Service – service providing technical assistance via the Application or phone as listed on the Website.

1.12. Service Cost / Tariff – monetary compensation established by the Operator for 1 kWh of Service.

1.13. Service – charging of the User’s electric vehicle battery at the Operator’s stations. The Service is not the sale of electricity and does not require a license.

1.14. Electric Charging Station (EVCS) – equipment that charges electric vehicles.

1.15. Electric Vehicle – a vehicle powered solely by an electric motor.

Other terms shall be interpreted according to their commonly accepted meanings.

2. GENERAL PROVISIONS

2.1. This Agreement is made available to the User in the Application. Registration in the Application and/or use of FOREVO charging stations constitutes full and unconditional acceptance of this Agreement.

2.2. Acceptance is confirmed when the User registers in the Application and clicks“Accept and Continue.”

2.3. The Operator may unilaterally amend the Agreement by publishing an updatedversion on the Website or in the Application. Users will be notified of significantchanges through the Application or via SMS (where applicable).

3. SUBJECT OF THE AGREEMENT

3.1. The Operator provides the Services through the EVCS Network.

3.2. Payment for the Service is made via international payment cards (Visa/MasterCard) or other methods specified in the Application. All Tariffs are setand billed in AED (United Arab Emirates Dirhams).

3.3. The volume of Service is determined by the EVCS electricity meter, which the User accepts as accurate. The readings of the electricity meter are considered final for billing purposes.

3.4. All funds received are at the discretion of the Operator for Service provision.

4. OBLIGATIONS OF THE PARTIES

Operator shall:

- Provide Service when sufficient funds are available.
- Maintain records of Services and ensure technical support.
- Conduct maintenance and repairs of EVCS and inform Users of outages.
- Adjust tariffs, introduce new services, or engage third parties at its discretion.
- Relocate or increase/decrease EVCS as needed.
- Collect and process User data in compliance with UAE laws.
- Use certified payment processors compliant with international security standards.

User shall:

- Register in the Application to access Services.
- Maintain confidentiality of login credentials.
- Pay for Services according to Tariffs.
- Comply with this Agreement and UAE laws.
- Use certified electric vehicles and charging equipment.
- Disconnect vehicles promptly and handle EVCS with care.
- Report technical issues or unauthorized access promptly.
- Provide accurate and updated personal information in the Application.

User shall:

- Receive up-to-date tariff information.
- Access paid Services of acceptable quality.
- Terminate the Agreement at any time if obligations are fulfilled.

5. PRICES AND PAYMENT

5.1. Service cost is based on the current Tariffs

5.2. Information on Tariffs is available on the Website and/or Application.

5.3. Payments are processed by certified payment providers.

5.4. Users must pay for Services according to Tariffs and the volume of Service received.

5.5. Discounts may be applied at the Operator’s discretion.

5.6. Electricity consumption is measured by EVCS devices and is provided for billing purposes only.

5.7. The Operator does not store full payment card details; all payments are encrypted and processed securely.

5.8. Each Charging Session is automatically billed upon completion.

6. LIABILITY

6.1. The Operator is not liable for issues caused by device malfunction, power interruptions, or third-party interference.

6.2. The Operator is not responsible for damages caused by the User’s defective vehicle or charging equipment.

6.3. Users are responsible for unauthorized access, accurate registration data, and damages caused during the Service.

6.4. The Operator is not liable for indirect or consequential damages.

6.5. The Operator is not responsible for any losses resulting from the User’s failure to follow EVCS safety instructions or improper use of cables, adapters, or vehicles.

7. ADDITIONAL TERMS

7.1. Amendments will be published on the Website.

7.2. Operator may suspend services due to legal or technical reasons.

7.3. Disputes will be resolved under UAE law, primarily via negotiation and, if necessary, in UAE courts.

7.4. Users consent to processing of personal data in accordance with UAE privacy laws.

7.5. Refunds may be provided only in cases of:

– charging session failure;

– double billing;

– technical malfunction that caused incorrect charging.

Refunds are issued to the original payment method following verification.

8. OPERATING RULES FOR EVCS

8.1. Do not tamper with EVCS or connect non-electric vehicle devices.

8.2. Disconnect vehicles after charging and leave the area clean.

8.3. Use certified cables/adapters.

8.4. Follow instructions from Operator staff.

8.5. The User must vacate the charging spot promptly after the session ends to avoid blocking access for other drivers.

8.6. Only vehicles compatible with the EVCS connector type may be charged.

9. FORCE MAJEURE

Parties are exempt from liability for non-performance due to events beyond their control, including natural disasters, war, or government actions in the UAE.

10. AGREEMENT TERM

10.1. Effective from registration in the Application until terminated by the User or Operator.

10.2. Termination of this Agreement is carried out by deleting the User’s Account from the Application. The User’s Account may be deleted by the Technical Support Service on its own initiative or upon the User’s request. Refund of any remaining Internal Balance may be processed upon account deletion, subject to identity verification.

11. CONFIDENTIAL INFORMATION

11.1. User login, passwords, and personal/payment data are confidential.

11.2. Disclosure is allowed under UAE law, sale of the Operator, or corporaterestructuring.

11.3. The Operator follows UAE Federal Decree-Law No. 45 of 2021 regarding Personal Data Protection.
